The Accra High Court has placed an injunction on the planned December 13 funeral of the late music icon Daddy Lumba, following an application by his maternal relatives.

In its ruling, the court restrained the first respondent from proceeding with the burial and further directed the third respondent not to release the body from the mortuary until the substantive case is fully determined.

The judge emphasised the need to carefully assess the merits of the issues raised, noting that affidavits before the court suggested the deceased’s immediate family may have been sidelined in the funeral preparations. Although the court acknowledged that delaying the burial could lead to additional costs, it underscored that due process and full family involvement could not be compromised.

The court reaffirmed that while the family head traditionally has the authority to lead funeral arrangements, this authority must be exercised in consultation with the deceased’s immediate family.

The injunction remains in place until the final determination of the matter.
