Ghana’s judiciary is the cornerstone of justice, the guardian of constitutional order, and a beacon of the rule of law on our continent. At the heart of this esteemed institution is the Chief Justice of the Republic of Ghana, His Lordship, Justice Paul Baffoe-Bonnie, whose distinguished career across all levels of Ghana’s courts has profoundly shaped our legal landscape. Since your appointment to the Supreme Court in 2008 and now as Chief Justice, your visionary leadership has strengthened judicial integrity, professionalism, and public confidence.
Your contributions are remarkable, from pioneering Electoral Law Reforms, authoring the Manual on Election Adjudication, and training judges and magistrates nationwide, to representing Ghana in ECOWAS Court of Justice forums and other international judicial discussions.
Your tireless dedication has not only shaped procedural standards and legal doctrine but inspired generations of judicial officers, reinforcing Ghana’s standing domestically and globally.
It is against this backdrop of exceptional service and a clear vision for judicial reforms that I respectfully submit the following recommendations to further enhance the judiciary’s capacity in handling extradition and high-risk legal matters:
1. Assignment of Specialized Legal Practitioners
To ensure the credibility and effectiveness of state prosecutions, the State must assign lawyers who possess the precise expertise required for each category of case.
These should include:
• International Extradition Lawyers for cross-border proceedings.
• Criminal Defence and State Prosecution Specialists for complex criminal cases.
• Human Rights Lawyers to safeguard constitutional and international protections.
• Immigration and Transnational Crime Lawyers for foreign nationals and cross-jurisdictional cases.
• Appeals and Constitutional Lawyers to maintain coherence and professional rigor at appellate levels.
Assigning lawyers outside their field of specialization introduces unacceptable risks, including procedural errors, misinterpretation of the law, delays in prosecution, and damage to the credibility of the judiciary. Only specialized professionals possess the knowledge, technical competence, and experience to ensure prosecutorial accuracy and uphold Ghana’s legal standing domestically and internationally.
2. Accuracy and Investigative Rigour. All cases, particularly extradition matters, must be grounded in thoroughly verified intelligence and professionally conducted investigations. Ensuring accuracy at this stage protects the courts, strengthens the integrity of prosecutions, and prevents avoidable errors that could compromise justice
3. Judicial Security, Surveillance, and Transportation
I make a strong and urgent appeal for:
• Dedicated and secured means of transportation for judges, prosecutors, as well as detainees in a coordinated seamless fashion. This can be replicated in the security agencies where it’s of enormous paramount importance in enhancing safe and transparent and effective administration of justice deliveey.
The safety and dignity of judges and prosecutors, as they discharge their duties, must be prioritized, while detainees must be transported securely to preserve both human rights and the integrity of judicial processes. Special attention must be given to the officers tasked with escorting detainees, ensuring that all vehicles and equipment are of the highest standard, fully secure, and meticulously maintained.
This is far more than a logistical consideration. It is a critical safeguard against potential vulnerabilities that could compromise personnel safety, detainee security, and the credibility of judicial proceedings, thereby preventing exposure to avoidable operational risks and reinforcing public confidence in our justice system.
• Enhanced surveillance systems in and around court premises to ensure real-time monitoring, rapid incident response, and continuous protection of judicial officers, staff, and visitors. Such systems act as both a deterrent against threats and a safeguard of the integrity of proceedings, reinforcing public confidence in the judiciary’s security and professionalism.
• Modern courtroom technology. With the advent of technology, with systems globally advancing and permeating every aspect of judicial operations, our courts must evolve in tandem and Usain Bolt bolt pace. Modern courtroom technology, including state-of-the-art audio-visual recording systems, should be deployed to capture proceedings in real time, preserve indisputable records, and facilitate efficient appeals. Such advancements demand specialists with exceptional, internationally recognized competencies to build and manage them, ensuring that our judiciary remains at the forefront of transparency, accountability, and global best practices in justice administration.
4. Institutional Collaboration
Seamless coordination between the Police Service, Judicial Service, and Prisons Service is critical to safeguarding detainees while preserving evidence and upholding the integrity of proceedings. When these agencies work in unison, the judiciary is empowered to operate efficiently and efficiently and tacitly and encrypted and secured data with very little or no chance of ever being compromised.
Your Lordship, the implementation of these measures is not merely procedural, its strategic investment in the soul of Ghana’s judiciary. When our courts are professionally supported, technologically equipped, and secure, justice is not only done but it is seen to be done, re-enforcing public trust and Ghana’s global reputation.
